The presiding judge in the action has sole discretion to appoint Mr. Singer as the partition referee. After he is appointed, Mr. Singer acts as a neutral third party whose primary function is to carry out the orders of the court as determined by the judge as they pertain to the partition action.
In order for Mr. Singer to be appointed by the the judge, the judge must interpret the Code of Civil Procedure and decide if the case warrants the appointment of Mr. Singer as partition referee over the action. As interpreted in CCP 873.010 (a), “The court shall appoint a referee to divide or sell the property as ordered by the court.” It continues: CCP 873.210 which allows that Mr. Singer be “appointed through an interlocutory judgment.” And according to CCP 873.060, Mr. Singer may be appointed as partition referee by the judge to “perform any acts necessary to exercise the authority conferred by this title or by order of this court.”
Once appointed, Mr. Singer, on behalf of the presiding judge and the court may :
- Sign most documents including but not limited to: closing paperwork, deeds, listing agreement, and purchase contracts.
- Hire most personnel including: Attorney(s) and Real Estate Agent(s).
Once Mr. Singer has been appointed partition referee, he becomes responsible for all processes in the partition of the property and any other court-ordered duties.
